The following conditions must be met:
- Police certificate of conduct are issued only if you have a legal right to request one. It is not issued on a general basis.
- A person must be required to show the certificate before they start working or studying, or take up a position of trust.
- When the police certificate of conduct is shown to the person requesting it, it must not be more than three months old.
- You cannot request a new certificate if the person still has the same job or position of trust.
- You can request a new certificate if the person concerned gets a new job or if they left the job or position for a period of time and have now gone back to it. This also applies if the nature of the work they have to do changes. In such cases, you must give the person applying for a new police certificate of conduct an updated confirmation of its purpose.
As an employer or client, you are responsible for knowing whether you can request a police certificate of conduct from an employee, student or other person.
Staffing agencies cannot demand to see the police certificate itself
Staffing agencies can only confirm that a person will have an assignment that requires a police certificate. The police specify that only the employer or client can require the police certificate to be presented and that the staffing agencies are not authorized to do so.
